97th Constitutional Amendment

The Constitution (Ninety Seventh Amendment) Act, 2011 has come into force from 12th January, 2012. The official Gazette notification can be found here: http://indiacode.nic.in/coiweb/amend/amend97.pdf

The amendment act makes certain changes in Article 19 (1) (c) and under Part IV of the Constitution Article 43B has been added. The amendment focuses on the rights of co-operative societies in India.

  1. Section 2 of the Notification states that it shall come into force from a date , the Central Government shall notify . Whereas , the website states that it is in force from the date of the assent of the President.
    Can anyone clarify the position

  2. Please read this part of the amendment;
    243ZT. Notwithstanding anything in this Part, any provision of any law relating
    to co-operative societies in force in a State immediately before the commencement of
    the Constitution (One Hundred and Eleventh Amendment) Act, 2009, which is
    inconsistent with the provisions of this Part, shall continue to be in force until amended
    or repealed by a competent Legislature or other competent authority or until the
    expiration of one year from such commencement, whichever is less.’.

    Now more than one year given to State Legislature for removing the inconsistancies in their State Cooperative Laws, has already passed and therefore it is in force, I believe.
